  • an organisation lawfully operating in Australia
  • Government agency
  • Foreign government agency
  • Religious Institution

Scope

This visa allows people to take part in workplace-based training to improve their skills for their job, area of tertiary study, field of expertise or in a professional development training program in Australia.

Nomination* requirements are different depending on the purpose or type of training.

*Nomination is the stage where the sponsor provides details about the nominee (intended trainee), the purpose or type of training, and how and where the training will be provided

There are 3 types of occupational training covered by this visa:

  • Occupational training required for registration
  • Occupational training to improve skills in an eligible occupation
  • Occupational training for capacity building overseas. This includes overseas qualification, government support or professional.

How long sponsorship lasts

We will let you  know how long your sponsorship will last when we approve it. Usually sponsorship lasts for 5 years starting from the date of approval.

Sponsor obligations

You must meet your obligations as a Temporary Activities sponsor..

You are responsible for meeting these obligations even if you appoint someone to act for you.

Processing times for sponsorship applications

Your application may take longer to process if:

  • you do not complete it correctly
  • you do not include all the documents we need
  • we need more information from you
  • it takes us time to verify your information
  • you do not pay the correct fee

Withdraw sponsorship

You can withdraw your sponsorship at any time before we decide on the visa application.

You must make your request in writing and include:

  • your full name
  • your date of birth
  • the file reference number or Client ID

You cannot withdraw sponsorship after we have made our decision.

If you withdraw your sponsorship before a visa is granted the visa is usually refused. We may invite the applicant to provide another sponsor.

Provide the occupational training directly

You must directly provide the occupational training, unless you are a Australian Commonwealth Government agency or have an exemption.

Exemptions

You may be exempt from the requirement to provide occupation training directly if:

  • the sponsor is supported by a national Australian Government agency
  • the sponsor is identified in the legislative instrument
  • the occupational training is provided as outlined in the legislative instrument

Be an approved temporary activities sponsor

You must be an approved temporary activities sponsor to sponsor an applicant for this visa.

Step 1

Before the applicant applies for the visa

This is a sponsored visa. You must have applied or already been approved as a sponsor before starting a nomination.

Australian Commonwealth Government agencies do not need to submit a nomination application.

How to nominate

We need information on:

  • nomination type
  • proposed training program
  • the position
  • skills, qualification and experience needed for the position
  • the person nominated to fill the position

You will need to apply online using ImmiAccount to nominate this visa.

Who can nominate an applicant?

You can nominate someone for this visa if you are:

  • an approved temporary activities sponsor or
  • you have already submitted an application to become an approved temporary activities sponsor

Your nomination application cannot be approved until your sponsorship is approved.

National Australian Government agencies

National Australian Government agencies do not need to submit a nomination.

They must provide a letter stating:

  • they agree to be the sponsor (and this may also include family members)
  • the type, location and length of the training

This letter should be included with the visa application.

Wages and salary

Occupational trainees are paid in line with Australia's laws. Include a copy of the training contract or agreement with the nomination. You also need to include the wages and salary to be paid.

You must provide evidence of a direct employment arrangement unless an exemption applies.

If the role is unpaid:

  • the sponsor and the applicant should complete:
    • Form 1283 Acknowledgement of unpaid placement—visa applicant (131KB PDF)
    • Form 1284 Acknowledgement of unpaid placement—sponsor (136KB PDF)
  • the sponsor should submit this form with the nomination using ImmiAccount

Nomination types

Nomination requirements are different depending on the purpose or type of training.

There are 3 types of occupational training covered by this visa:

  • workplace training required for registration
  • structured workplace training to improve skills in an eligible occupation
  • training that promotes capacity building in a foreign country. This includes overseas qualification, government support or professional development

Cost to nominate

AUD170

You must provide all relevant documents and pay the nomination charge when you apply.

How long the nomination lasts

Your nomination lasts up to 12 months, or on the earliest of:

  • the day we are notified you withdraw your nomination in writing
  • 3 months after your approval as a sponsor ends
  • the day we cancel your approval as a sponsor
  • the day we grant the applicant a visa

Step 2

Gather your documents

There are a number of documents you need to provide as part of your nomination application.

Volunteer documents

If the nominee will not be paid to attend the training there are two forms to be completed.

  • Form 1283 Acknowledgement of unpaid placement—visa applicant (131KB PDF)
  • Form 1284 Acknowledgement of unpaid placement—sponsor (136KB PDF)

The forms should only be completed if you are satisfied that you will not be entering into an employment arrangement with the visa applicant:

  • An employment contract can arise even when a person agrees not to be paid wages for the work/training they do
  • In cases where a person is actually an employee, they are entitled to pay and conditions under the Fair Work Act.
  • You should make independent enquiries and, as appropriate, provide evidence that the proposed unpaid placement is lawful.

General training arrangements

You need to give us:

  • a copy of the training contract or agreement, include pay if the visa applicant will be an employee*
  • details of all periods and places of training. This includes on-the-job training, classroom-based training and supervised work activities
  • a letter from an Australian Commonwealth Government agency if they support you engaging other organisations to train the nominee
  • a statement confirming the nominee has functional English language skills to take part in the training
  • copies of the nominee's registration or licence, required for the training

Occupational training required for registration

You should provide a letter from the relevant regulatory body for the occupation in Australia or the nominee's home country. This letter must :

  • state the nominated training is necessary for the nominee to get registration, membership or licensing to work in the occupation
  • name the person nominated for the training

You must also give us a copy of the nominee's relevant qualification and curriculum vitae (CV).

If you are a health practitioner treating patients as part of your occupational training you should:

  • have a letter from the relevant registration authority, or
  • regulatory body stating the nominee has conditional registration for the training

Occupational training to improve skills in an eligible occupation

Provide us with:

  • a copy of the nominee's relevant qualifications and CV
  • a copy of the structured workplace-based training program. The training program should include:
    • an assessment of the nominated trainee’s current level of skill in the identified occupation
    • specifically tailored training needs analysis and learning outcomes, including how they will be monitored and assessed
    • the tasks to be completed should include timeframes for completion, and show and increase in difficulty and complexity over the course of the training program
    • details of all supervisors, trainers and assessors, including their qualifications and experience

If you are a health practitioner treating patients as part of your occupational training you should:

  • have a letter from the relevant registration authority, or
  • regulatory body stating the nominee has conditional registration for the training

Occupational training for capacity building overseas

You need to give us:

  • a copy of the nominee's relevant qualification and CV
  • a copy of the structured workplace-based training program or professional development program (as applicable)

Workplace –based training programs must be specifically tailored to the learning needs of the nominee and should include:

  • an assessment of the nominated trainee’s current level of skill in the identified occupation
  • a training needs analysis and planned learning outcomes, including how they will be monitored and assessed
  • the tasks to be completed should include timeframes for completion, and show and increase in difficulty and complexity over the course of the training program
  • details of all supervisors, trainers and assessors, including their qualifications and experience

You must also give us one of the following:

  • Overseas qualification -  provide a letter from the nominee's education provider in their home country. It should state that practical experience, research or observation is needed for the nominee's course.
  • Government support -  provide a letter of support from a government agency in Australia or the nominee's home country. This letter should state the training promotes international capacity building.
  • Professional development - provide:
    • a signed letter from the nominee's overseas employer. Include the nominee's current position with the employer
    • evidence of how the occupational training program will provide skills and expertise relevant to the employer's business and the nominee's development
    • a statement confirming you are satisfied the nominee will be doing the professional development training. Also include if the nominee has relevant managerial or professional skills. Please tell us if they have the experience to participate in the program

Step 3

Apply

  1. Log in or create an ImmiAccount
  2. Attach documents
  3. Pay the application fee. We will not process your application until you pay the fee.
  4. Note the Transaction reference number, you need to provide this to the applicant

Let us know if your circumstances change through your ImmiAccount

You cannot withdraw as a sponsor after we grant the visa.

Provide the visa applicant with supporting documents

Give the applicant:

  • your sponsorship application transaction reference number (TRN) or sponsorship application ID, if you are a Australian Commonwealth Government agency
  • your nomination application transaction reference number (TRN) or nomination application ID, if you are not a Australian Commonwealth Government agency
  • a written statement that you will meet your sponsorship obligations to the applicant and any family they include in their application
  • the invitation to participate in training, if you are an Australian Commonwealth Government agency

Nomination outcome

We will send you a letter to tell you if your nomination is approved or not.

If your nomination is approved

We will send you a letter with:

  • your nomination identification number
  • the date your nomination ceases

You must keep this letter because it will be needed for the visa applications of the people you are nominating.

If your nomination is not approved

We will send you a letter stating:

  • why the application was refused
  • your rights (if any) to a merits review of the decision and time limits to apply for review

Your obligations

You must meet your obligations as a Temporary Activities Sponsor. See more about temporary activities sponsor obligations.

You are responsible for meeting these obligations even if you appoint someone, such as a migration agent, to act for you.

Withdraw sponsorship

You can't withdraw your sponsorship after a visa is granted.

Tell us if things change

You must notify us through ImmiAccount if any of the following happens:

  • your address or contact details change
  • the person you sponsored does not start in the position, program or activity we granted the visa for
  • the person you sponsored unexpectedly ends their position, program or activity we granted the visa for
  • there are changes to the formal arrangement or agreement with the person you sponsor
  • you change the date of when the person you sponsored will end their position, program or activity
  • your legal entity ceases to exist
